1. Acceptance of Terms

Welcome to Sipadan Deep Diving Adventures. These Terms of Service ("Terms") govern your use of our website, services, and diving activities. By accessing our website, booking our services, or participating in our diving activities, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services or participate in our activities.

2. About Our Services

Sipadan Deep Diving Adventures provides recreational diving services, including but not limited to:

• Private diving lessons and instruction
• PADI certification courses
• Guided diving tours in Sipadan waters
• Underwater photography tours
• Equipment rental and sales
• Marine conservation education

3. Eligibility and Requirements

3.1 Age Requirements

• Participants must be at least 10 years old for basic diving activities
• Participants under 18 must have parental or guardian consent
• Age-specific restrictions may apply to certain courses and activities

3.2 Health and Fitness Requirements

• All participants must complete a medical questionnaire
• Participants with certain medical conditions may require physician clearance
• Participants must be physically fit for diving activities
• Pregnancy restrictions apply in accordance with diving safety standards

3.3 Certification and Experience

• Certified divers must present valid certification cards
• Experience requirements vary by dive site and conditions
• Refresher training may be required for inactive divers

4. Booking and Payment

4.1 Reservations

Reservations are required for all diving activities and are subject to availability. Bookings are confirmed upon receipt of required deposits and completion of necessary paperwork.

4.2 Payment Terms

• Deposits are required to secure bookings
• Full payment is due according to the schedule provided at booking
• We accept various payment methods as specified at booking
• All prices are in Malaysian Ringgit (MYR) unless otherwise stated

4.3 Sipadan Permits

Sipadan Island diving requires special permits with limited daily quotas. Permit fees are separate from our service fees and are subject to government regulations and availability.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Cancellations more than 7 days before the activity: Full refund minus 10% administrative fee
• Cancellations 3-7 days before: 50% refund
• Cancellations less than 3 days before: No refund
• No-shows: No refund

5.2 Weather and Safety Cancellations

We reserve the right to cancel activities due to unsafe weather or sea conditions. In such cases, we will offer rescheduling or full refunds.

5.3 Permit-Related Cancellations

If Sipadan permits cannot be obtained, we will offer alternative dive sites or full refunds for the permit-dependent portion of the booking.

6. Safety and Liability

6.1 Assumption of Risk

Diving is an inherently risky activity. By participating, you acknowledge and assume all risks associated with diving, including but not limited to:

• Risk of serious injury or death
• Equipment malfunction
• Environmental hazards
• Marine life encounters
• Weather and sea conditions

6.2 Safety Rules and Instructions

All participants must:

• Follow all safety briefings and instructions
• Dive within their certification limits
• Use provided safety equipment properly
• Report any medical conditions or concerns
• Follow the buddy system and dive guide instructions

6.3 Limitation of Liability

To the maximum extent permitted by law, Sipadan Deep Diving Adventures, its employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your participation in our activities.

7. Equipment and Property

7.1 Equipment Rental

• Rented equipment must be returned in the same condition
• Participants are responsible for loss or damage to rented equipment
• Equipment inspections are conducted before and after use

7.2 Personal Property

We are not responsible for loss, theft, or damage to personal property. Participants are advised to secure valuables and consider appropriate insurance coverage.

8. Photography and Media

We may take photographs or videos during activities for promotional purposes. By participating, you consent to the use of your likeness in our marketing materials unless you explicitly opt out.

9. Environmental Responsibility

All participants must adhere to marine conservation principles:

• Do not touch, damage, or remove marine life or coral
• Maintain proper buoyancy to avoid reef damage
• Follow Leave No Trace principles
• Respect marine park regulations

10. Code of Conduct

Participants are expected to:

• Treat staff, other participants, and marine life with respect
• Follow all local laws and regulations
• Refrain from alcohol or drug use before diving
• Report any safety concerns immediately

We reserve the right to refuse service or remove participants who violate our code of conduct.

11. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, or other force majeure events.

12. Intellectual Property

All content on our website, including text, images, logos, and materials, is protected by intellectual property rights. You may not use our content without explicit written permission.

13. Privacy
